Identification Requirements
All document signers must present one of the government issued forms of identification listed below. The ID must be current & unexpired. The State of California requires that only the following can be used:
> Identification card or driver's license issued by the California Department of Motor Vehicles.
> Identification card or driver's license issued by another state.
> A driver's license from Canada or Mexico, issued by the public agency authorized to issue driver's licenses.
> United States passport.
> Passport issued by a foreign government, provided it has been stamped by the U.S. Immigration & Naturalization Service or U.S. Citizenship & Immigration Services.
> United States military identification card with the required photograph, description of the person, signature of the person, and an identifying number.
> An inmate identification card issued by the California Department of Corrections and Rehabilitation, if the inmate is in custody.
> An employee identification card issued by an agency or office of the State of California, or an agency or office of the city, county, or city and county in California with a photograph, description, & signature of the person and an identifying number.
If the document signer does not have a form of ID listed above, & if it would be extremely difficult or impossible for them to obtain one, they can use two credible witnesses - two people, age 18 or older, who know the signer and who each present one of the acceptable forms of ID. They must attest to the identity of the signer, take a verbal oath, and sign the Notary's journal. The credible witnesses cannot be named in the document, nor can they have a financial interest in the transaction described in the document.
When the Signers Name is Pre-Printed on the Document
When the signers name is pre-printed on the document, the name on the ID must be “equal to or greater than’ the name on the document. For example, if the signers ID reads Robert P. Smith, he may sign as either Robert P. Smith, Robert Smith, or even R.P. Smith. He may not sign as Bob Smith, or Robert Paul Smith as these elements are not on the identification (a notary may not certify a name, nick-name, or element of a name that does not appear on the identification document).
Exception, if the suffix Jr., Sr., or II, III, (etc.) appear on the either the document or ID, they must also appear on the ID &/or document.
